MERRITT ISLAND, Florida – A 60-year-old man was seen throwing a liquor bottle on the ground at Jefferson Middle School, according to the Brevard County Sheriff’s Office.

On Tuesday, deputies observed Bernard Ashby McIlhany, of Merritt Island, sitting in a running vehicle near the exit of the school.

A few moments later, McIlhany thew an empty liquor bottle on the school grounds, the report said.

“Upon making contact, he displayed obvious signs of impairment,” the deputy said.

McIlhany was unable to perform standard exercises to determine if he was too impaired to drive.

However, he did submit a breath test yielding the results of .130 and .133.

McIlhany was charged with DUI.
