MELBOURNE, Florida – On Monday at approximately 11:55 a.m., a man killed three ducks at the edge of a retention pond behind his home located at the 3500 block of Mount Carmel Lane, according to the Melbourne Police Department.
Magdiel Marrero-Pena, 41, was charged with four counts of aggravated cruelty to animals.
According to Melbourne Police, Marrero-Pena used a stick and repeatedly struck one adult duck and two juvenile ducklings to death.
The beating caused the ducks’ feathers to be partially removed as Marrero-Pena was killing them, the report said.
When officers confronted Marrero-Pena about the bodies of ducks left in his backyard, he spontaneously uttered that he killed them with a three-foot stick as the adult duck was attacking him, according to the affidavit.
“It should be noted that the body of the adult duck was about three feet from the bank of the pond and the babies were about five to seven feet from the pond,” the officer said.
According to a City of Melbourne code, “all lands and waters within the city are hereby declared to be and are designed as a wildlife sanctuary and as such, it shall be unlawful for any person to intentionally kill or injure any bird, waterfowl or wild animal within said area.”
Marrero-Pena was arrested and transported to the Brevard County Jail where he is being held on $20,000 bond.
According to jail records, Marrero-Pena was arrested for battery domestic violence in September 2017. He was also arrested on three counts of battery in October 2016.
