PALM BAY – Matthew Dibenedetto, 18, pulled out his gun after witnessing an armed robbery at the Wendy’s located at 1755 Palm Bay Rd. on Saturday, January 19, 2019.
After the armed robber left the location, Dibenedetto pulled out his gun and stated, “I could have done something, I have my fire right here.”
An employee at the restaurant told Palm Bay Police that “he was in fear for his life,” when Dibenedetto pulled out the firearm and told him to leave the store.
Dibenedetto, who turned 18 years of age in December, was confirmed to be an adjudicated delinquent by the Department of Juvenile Justice.
Law enforcement went to the 1300 block of Hedgcoth St.NW, in Palm Bay, as they received information that Dibenedetto was hiding out there.
When the defendant was being placed into custody officers observed a clear plastic bag that was filled with Xanax at his feet. The total packaged weight was 7.0 grams.
On Sunday, January 20, 2019, Dibenedetto was arrested and charged with Aggravated Assault W/Deadly Weapon WO Intent Kill, Possession of a Weapon/Ammo by Florida Delinquent Adult Felony, Controlled Substance – Possession WO Prescription, and Possession/Use Drug Paraphernalia.
His bond was set at $77,500.
