PALM BAY, Florida – Deputies with the Brevard County Sheriff’s Office were dispatched to the 300 block of Brandt Ave in Palm Bay in reference to a man with a gun, according to the report.
The incident occurred Sunday when the victim was visiting his sister. According to the victim, he was on the roof of his sister’s home when Joseph W. Fry, 48, came out and began to argue with him for being on the roof.
“The victim was telling the defendant to go inside and leave him alone,” the deputy said.
Fry got so upset that he threatened to “get his gun” while the victim called him names. He went into the home, retrieved a small firearm, and threatened to shoot the victim.
“The defendant then pulled the trigger as he pointed the gun at the victim,” the report said. The firearm was not loaded, but the victim stated he heard a “dry shot,” according to the affidavit.
Fry was arrested and charged with Aggravated Assault with a Deadly Weapon.
As of Tuesday afternoon, he’s still in the Brevard County Jail on a $15,000 bond.
