Palm Bay Man Forces A Gun Barrel Into Victim’s Mouth

PALM BAY – On Thursday at approximately 3:15 a.m., the Palm Bay Police Department responded to the 900 Block of Sable Cir in reference to a battery involving a firearm.

The victim stated she was inside the living room watching television with the defendant, Calvin T. Lindsey. The victim and Lindsey engaged in a verbal disturbance with each other because the defendant was talking too much during a tv show.

During the course of the dispute, Lindsey walked into the master bedroom and closed the door. The victim walked to the master bedroom to retrieve a blanket. As she approached the closed bedroom door, she heard the sound of Lindsey racking a shotgun, according to the affidavit.

The victim opened the bedroom door, stood in the doorway and accused Lindsey of trying to intimidate her. Lindsey pushed the victim down on the floor and then retrieved a Sig Sauer 9mm handgun.

The defendant then placed the barrel of the handgun inside the victim’s mouth as he stated something to the effect of, “You want to see intimidation?” He then struck the victim in the mouth area with the handgun, according to the affidavit.

As they continued to struggle, the defendant placed his hand over the victim’s neck and attempted to choke her, repeatedly banging her head against the floor. He then raised himself from off the victim and fired one round into the living room ceiling. That is when the victim called 911.

Lindsey told police that he did engage in a verbal dispute with the victim and during the dispute, the victim pointed a 9mm handgun at him. The Defendant engaged in a struggle with the victim in an attempt to disarm her, and the handgun accidentally discharged into the ceiling.

The victim had visible bruises on her back and neck, and minor cuts around the outside of her mouth. She also sustained a broken tooth located on the upper left quadrant of her mouth. This injury appeared consistent with being sustained from a gun barrel being forced into her mouth, according to the affidavit.

The defendant did not suffer any injuries. A Sig Sauer 9mm handgun, a Mossberg shotgun, and a spent 9mm casing were recovered at the scene and submitted into evidence.

Lindsey, 55, was arrested and charged with Aggravated Battery With A Deadly Weapon, and Aggravated Assault W/Deadly Weapon Without Intent To Kill.

He was transported to the Palm Bay Police Department for processing then transported to the Brevard County Jail.

His bond amount is $175,000.
