PALM BAY, Florida – A 24-year-old man is behind bars after he allegedly sexually assaulted a 17-year-old girl who was sleeping, according to Palm Bay police.

Joshua Cinton Rivera was arrested after the girl told a friend about the incident.

The girl was visiting from out of town when she went to a nightclub in downtown Melbourne with a friend, including Rivera.

Palm Bay investigators said the teen and the others got back to a residence at 4 a.m.

A short time later, while sleeping, the teenage girl woke up to find Rivera hovering over her, fondling her and performing sexual acts.

The teen resisted and moved to another room and later told a friend, according to the report.

During the arrest, Rivera told officers he initially thought the teen was 22 years old, but said he learned she was a teen.

Rivera was transported to the Brevard County Jail Complex where he is being held on a $35,000 bond.
