PALM BAY – On Sunday, December 16, 2018, the Palm Bay Police Department received a complaint of a vehicle crash in the area of Sapodilla Rd SW and Penfield St SW.

“Upon my arrival and making contact with the defendant. I informed the defendant of the DUI investigation and read Miranda. I defendant made utterances such as that the incident was his fault,” an officer on scene stated in the affidavit.

“He also admitted after Miranda that he was operating the vehicle. During the invest, I detected an odor of an alcoholic beverage coming from the defendant and noticed slurred speech, a fixed gaze, red/bloodshot and watery eyes, etc., the officer stated in the affidavit.

William Edward Wilcher, 41, was given field sobriety tests by a law enforcement officer and it was determined that he was under the influence.

He was arrested for driving under the influence and refused after implied consent to take a breath test. Wilcher caused injury to his passenger, who sustained internal injuries to her lungs.

The defendant was transferred to the Emergency Room, where he began to physically resist an officer by squeezing his hand and wrist with his arm to his body and attempting to pull him. He also attempted to pull his arm and body away from the officer in an attempt to break free according to the affidavit.

Wilcher is currently on probation. The ATV/4×4 he was operating on the roadway is not registered to operate on a roadway.

Wilcher, of Palm Bay, was arrested for DUI Alcohol or Drugs 3rd Violation Within 10 Years, DUI Damage to Prop/Person of Another, Violation On Site, Resist Officer Without Violence, Refuse to Submit DUI Test After License Suspension, and Fail to Register Motor Vehicle.

He was turned over to the Brevard County Sheriff Office and was given a Bond of $17,000.
