WEST MELBOURNE, Florida – A 39-year-old man was arrested by the West Melbourne Police Department after causing a disturbance at the Race Trac gas station, and telling officers to kill him, according to the report.

On Tuesday night at approximately 9:00 p.m., police received a call from the Race Trac in West Melbourne about a man disrupting the business.

James C. Giddens asked to use the business phone multiple times, but the clerk declined. Giddens grabbed the phone anyway and attempted to use it.

“The defendant disrupted the peace and quiet of customers and employees within the business by arguing with the store clerks over the use of the store phone,” the officer said.

When officers tried to detain Giddens, he resisted by kicking out his legs and pulling away.

“While tensing up and attempting to prevent arrest, the defendant advised he wanted cops to kill him, and he was going to make it happen,” the report said.

Race Trac trespassed Giddens from the property.

Giddens was arrested and transported to the Brevard County Jail where he was charged with resisting arrest, and breach of peace-disorderly conduct.
